i'm sure no one noticed, but i havent been a real contributor lately. I was in trial against the IRS for about two weeks and... I fought the Law, but I won! Actually our client won. It was a very complex issue, which i'd be happy to explain if anyone wants me to. It was a bench trial (my first) and I was actually complimented by the judge on... my tie for closing argument. whatever. the result is what counts. Glad to see everyone's still here. Hope all is well.

Cliff is considering suing the IRS over two corporate tax returns that were actually prepared by the IRS ten years ago when Cliffs accountant was gravely ill (he later died). However, Cliff is trying to determine whether there is a "statuite of limitations" that would make litigation unnecessary?

Cliff would have no grounds for a suite against the Grateful Dead. Any reasonable judge or jury would determine that whatever legitimate damages Cliff suffered attending 1980's shows has been more than off-set by the pleasure he continues to enjoy listening to the older material...

john is glad that cliff isn't suing the Grateful Dead. John is not a fan or the IRS so wishes Cliff good luck.

Also, thanks for that link, never saw that one before. John wonders why the 1980 Warfield run audience recordings ( or any Warfield audience recordings for that matter ) don't sound that good.

Our case involved what the Service considered an unreasonable accumulation of wealth by a corporation, for which there are penalties under Code section 534(c). The basic policy of that section is that corporations arent supposed to be hording money that they earn. Profits should either be paid out in dividends or invested in physical plant, good will, etc. When corporations keep all their money (for instance in a corporate savings account or something like that), the money stays out of the economy and the government doesnt get its bite of the apple (because the dividends will be taxed to the corp when paid out and taxed to the recipient as capital gains, or possibly ordinary income). I'm actually ideologically behind the policy for that section, but the Code gives you a way out. You can devise a 534(c) plan that earmarks the money for legitimate future corporate needs and supply the Service with sufficient facts to convince them that the purpose of accumulating is not to avoid (not evade) taxes. Our client did one of those plans without consultiong us firts and screwed themselves. But we bailed them out. Cliff- I hope your situation isnt too serious? p.s.- thanks for letting me explain!

Yuk. The mere thought makes me sick. What was he thinking? MUST have been someone talked him into it and he saw it as a way of helping THEM out. It's just such a sell out thing to do considering he never ever wore a tie.

Oh yeah I'm sure they are. And I can see liking having the tie ( no pun intended ) to the counter culture if one has ajob that requires you to wear a tie. I'd wear one if I was making bank. I just don't see why Jerry did it is all. Maybe a monogramed haines t-shirt or something : )

yep like jerry needed money from ties...and how much you think he actually made ...appreciate it for what it is and that's jerry's art....

and you know for a fact he never wore one no tthat it matters cause i wouldn't expect him to hawk his own stuff by wearing it ...surprise you still listen to jerry since he's a sell out ....

I never called him a sell out.
The only point I made - and I am by far not the only one including people he knew that has said the same thing - is that it is a STRANGE commodity for him to market. No I don't know that he never wore a tie for a FACT, but people who knew him have said that and I've never seen a picture of him in one other than the wedding photos of him with Koons where he's wearing a tux. MY hunch is that it was her or someone else that put him up to it and THAT's why he allowed it ( he didn't create the art specifically for the ties I don't think )so to help someone else out. That's all.

What the F ever. This is a dumb arguement. I think it's strange, so what? Want to know what else? I think most of his art sucks. That's MY opinion. Doesn't change one ioata the fact that I love his music and respect the hell out of him as a person.

Oh and ever hear that funny quote he made referencing the " disco dead" era?


I'm using quotes but I may have a word or two wrong but the meaning is 100% accurate.

who cares if theartwork wasnt created for the tie..it's jerry's artwork ...you don't have to like it ...but to label him a sell out is lame considering the other stuff that was always being hawked by the band .....did jerry have bumper stickers of the band on his cars or did he wear tie-dye shirts like phil ....

Dang, I guess I did say that. Guilty as charged.

I still think it strange. I think a lot of the shit they sold is lame - golf balls? But it kept the machine rollin ( and people they cared about in jobs ), and kept the mystique too. Personally I think these marketing things were for other people. Shit, the music and tours became about other people ( staff ), which did wonders to contribute to Jerry's demise. Phil says as much in his book.

Whatever man. To each their own. It's not like I'm all obsessed with it. Nor am I obsessed with having to worship everything they ever said or did. Finest band ever and they have brought me more joy than any other music - and I like a LOT of music. That's enough for me.

Enjoy your ties, and possibly your Jerry action figure or beanie baby. Maybe while sipping some Jerry brand wine. It's actually Clos DuBois with a Jerry label stuck on. It's still pretty good.

Yeah but Jerry never made ties either just the art that was put on them so then the wine is the same thing. The only difference is that at least he was alive to give the go ahead on the ties. Not so with other stuff ( like the cutesie doll ).

They have brought everyone a lot of joy. I don't know if anyone is aware, there is a lot of complete Dead concerts from the 70' to the 90's at tela.sugarmegs.org. They have two places to look for the concerts. They only allow downloading from 5 PM EST to 9 AM weekdays. The weekends are 24 hrs. The foour shows from 4-26-4-29-71, that someone mentioned earlier are there, plus loads more. They have to be downloaded as whole concerts, but it makes you feel like you are there. Hope someone else likes the site.

I haven't gone for any of the Dead stuff there cus it's all MP3 and there's so much Dead out there already. But for everything else ... WHOAH! Most extensive eclectic quality live collection anywhere I've seen. I can't dig with the tracks not being divided though. SOME day I'll get around to figuring that audacity out I hope.

Congratulations. Glad to see that you triumphed against the forces of evil-er, I mean, the IRS. Good for you. Personally, I (via my attorney) will be doing battle in criminal court next week. Not guilty as charged, my hopes run high, but I'm not booking any travel plans to celebrate the victory just yet.
